Lasting Power of Attorney

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint one or more people (attorneys) to help you make important decisions or to make decisions on your behalf if you become unable to do so.

It is a good way for you to ensure that you have provisions in place should you have an accident or illness that prevents you from making decisions.

There are two different types of LPA:

Property and financial affairs lasting Power of Attorney

This LPA gives an attorney the authority to make decisions and take action concerning money and property on your behalf. It covers things such as:

Bills

Collecting benefits

Pensions

Selling a home or property

Banking or buildings society accounts

Health and welfare lasting Power of Attorney

This LPA will allow your attorneys to make decisions on issues such as:

Your medical care or treatment

General welfare

Moving into a care home or provision of care in your own home

Life-sustaining treatment

Your attorneys can only make decisions under a Health and Welfare LPA if you lack the mental capacity to make those decisions personally.

What if I already have an Enduring Power of Attorney?

An EPA is still perfectly valid, but will only cover Property and Financial affairs, not Health and Welfare. You may wish to consider revoking the EPA and replacing it with both types of Lasting Power of Attorney. They provide much better protection against fraud, as well as health and welfare decision making powers.

Is it only possible to set up a Lasting Power of Attorney whilst you have the mental capacity to do so?

It is only possible to set up a Lasting Power of Attorney whilst you have the mental capacity to do so. Unfortunately, sometimes things are left too late. If you have a loved one in this situation, then please do get in touch. It may be possible to make an application to the Court of Protection for what is known as a ‘Deputyship Order’ and we can guide you through the process.

How much does Power of Attorney cost?

One Lasting Power of Attorney (i.e. either Property or Health)

£500 plus VAT*

Two Lasting Power of Attorney (i.e. both Property and Health)

£750 plus VAT*

Additional Office of the Public Guardian registration fee

£82 plus VAT*
